Justice Ayesha Malik makes history with her confirmation to the Supreme Court.

ISLAMABAD: President Arif Alvi granted final consent on Friday to the elevation of Lahore High Court Justice Ayesha Malik to the Supreme Court.

Justice Ayesha will be the first female Supreme Court judge in Pakistan’s judicial history. She will be sworn in on Monday, January 24, and her term will begin immediately. Gulzar Ahmad, Pakistan’s Chief Justice, will administer the oath to Malik.

Her inauguration will take place in the Supreme Court. Supreme Court justices, the attorney general of Pakistan, and the advocate general will all be present.

According to a statement released by the Ministry of Law and Justice, President Alvi authorised her appointment under Article 177, sub-section one.

The president’s assent comes after the Parliamentary Committee on Judges Appointments gave its official consent to the promotion on Wednesday.

After the Judicial Commission of Pakistan eventually agreed to her nomination, the committee, chaired by Law Minister Farooq H. Naek, voted to accept Justice Ayesha’s promotion.

After a heated debate over whether judges should be chosen based on merit or seniority, Pakistan’s Judicial Commission authorised the promotion on January 7 with a vote of five in favour and four against.

It is worth noting that Justice Ayesha Malik is the fourth most senior judge on the Lahore High Court, although she is largely regarded as a skilled judge.

While confirming the nomination, Law Minister stressed that the court was not abandoning the practise of appointing justices based on seniority, but Malik’s appointment as the first woman Supreme Court judge “will benefit the country.”

Justice Ayesha Malik has been nominated to fill the vacancy left by Justice Mushir Alam’s resignation on August 17.

The Chief Justice of Pakistan and the Chief Justice of the Lahore High Court both recommended her nomination. Justice Ayesha later consented to the elevation in writing.

According to the LHC website, Malik was born in 1966 and had her primary education in Paris, New York, and Karachi.

She earned her BCom from the Government College of Commerce and Economics in Karachi and her law degree from the Pakistan College of Law in Lahore.

She earned an LLM from Harvard Law School and has worked with Fakhurddin G Ebrahim. Justice Malik has appeared before the Supreme Court, District Courts, Banking Courts, Special Tribunals, and Arbitration Tribunals.

In family law trials in England and Australia regarding child custody, divorce, women’s rights, and constitutional protection for women in Pakistan, the judge was called upon as an expert witness.
