The Pakistani Supreme Court (SC) has ruled that issuing an ordinance without a state of emergency is a breach of the country’s constitution.
On the ordinance, the Supreme Court issued a written ruling, and Justice Qazi Faiz Issa drafted a 30-page judgement.
In its decision, the Supreme Court stated that every word of the constitution must be followed to the letter. The constitution specifies the procedure for issuing the ordinance.
The president and governors, according to the judgement, are unable to carry out the decree unless certain constitutional requirements are met. The ordinances are only in effect for a few months. The ordinance should be used to prevent long-term rights and duties. The legislative process must guarantee that people’s rights are protected.
