ISLAMABAD: Justice Mansoor Ali Shah and Athar Minallah, two senior judges of Pakistan’s Supreme Court (SC), have resigned, according to Channel News.
Justices Mansoor Ali Shah and Athar Minallah have submitted their resignations to President Asif Zardari.
Justice Mansoor Ali Shah’s resignation is seven pages long and declares the 27th Amendment a grave attack on Pakistan’s Constitution.
According to the senior judge, the 27th Amendment has taken justice away from the average man, leaving the weak impotent in the face of the strong.
He said that this amendment has split the country’s highest court and put the country back several decades by eroding the judiciary’s independence.
He also stated that he cannot keep his oath in a court whose constitutional duty has been stolen.
The judge said that the amendment was adopted by a government whose constitutional standing is now being reviewed.
Furthermore, the Supreme Court’s leadership adopted the amendment despite its unclear constitutional standing.
Pakistan has always had a single Supreme Court, which is our shared legacy, but the 27th Amendment demolished the framework of the Supreme Court and established a constitutional court above it, he noted.
He stated that the 27th Amendment was passed by parliament without any consultation, discussion, or opinion from the judiciary.
The main goal of the amendment is to grant the administration the authority to choose judges of their choosing.
