ISLAMABAD – Today (Tuesday), the Islamabad High Court (IHC) will continue hearing the appeal against the PTI chief’s punishment in the Toshakhana case.

The appeal for the suspension of PTI Chairman’s sentence will be heard by a two-member panel of the Islamabad High Court. The applications will be heard by Chief Justice Amir Farooq and Justice Tariq Mehmood Jahangiri.
The parties have received notifications from the court regarding the main petition’s sentence suspension. The registrar’s office was also mandated by the court to summon the case files. Attorney Khawaja Haris and Sardar Latif Khosa had advanced their cases during the prior session on behalf of the PTI chairman.

Tomorrow, a CJP-led panel will hear the PTI leader’s appeals of the Toshakhana decision.

The PTI chairman filed appeals against the Islamabad High Court’s decision in the Toshakhana issue, and the Supreme Court of Pakistan established a three-member panel on Monday to consider the applications.

The case will be heard on August 23 (Wednesday) by a bench presided over by Chief Justice of Pakistan Umar Ata Bandial and made up of Justices Mazahar Akbar Naqvi and Jamal Mandokhel.

The IHC’s decision to send the Toshakhana case back to the trial court for consideration of its admissibility has been contested by the former premier. On August 3, the IHC invalidated its prior ruling and once more remanded the Toshakhana case against the PTI head to the trial court for consideration of its maintainability.

The former prime minister’s petitions contesting the case’s admission, the court’s jurisdiction, and other parts of the case were answered by IHC Chief Justice Aamer Farooq.

The high court decided that Additional Sessions Judge Humayun Dilawar will continue to hear the case, rejecting the PTI leader’s request to transfer it to a different court.

The trial court had twice ruled that the matter could be maintained, thus the IHC remitted it to that court for the third time to make a determination about admissibility.

The case

Legislators from the ruling coalition filed a reference against him last year, accusing him of failing to disclose the specifics of gifts he kept from Toshakhana in his asset declarations. The Election Commission of Pakistan (ECP) came to the conclusion that the PTI chief had made false statements about the gifts in October of that same year.

Following his disqualification due to dishonesty and corruption, the electoral watchdog filed a criminal complaint against the PTI head for allegedly deceiving authorities about the presents with the district and sessions court.
