ISLAMABAD: One judge from the High Courts of Lahore, Sindh, and Balochistan was moved to the Islamabad High Court on Saturday, marking a significant development.

On this subject, an official notification has also been released.

The notification stated that Muhammad Asif of the BHC, Khadim Hussain Soomro of the SHC, and Sardar Muhammad Sarfraz Dogar of the LHC had been relocated.

Notably, IHC judges expressed their concerns over the appointment of a transferred judge to the IHC’s top post in a letter they sent to the chief justices (CJ) of the Supreme Court and higher courts on Friday.

They requested that they oppose such a development.

The seniority factor was not used to select the highest ranking judge, as per the new regulations of the Judicial Commission of Pakistan (JCP), which went into force last year. The JCP suggested that a high court’s chief justice may be chosen from a group of five judges with the highest seniority.

Justice Mohsin Akhtar Kayani, the senior puisne judge of the IHC, together with Justices Tariq Mehmood Jahangiri, Babar Sattar, Sardar Ejaz Ishaq Khan, and Saman Rafat Imtiaz, signed the letter. The letter also had the names of Justices Arbab Muhammad Tahir and Miangul Hassan Aurangzeb, but their signatures were not on it.

According to a previous report by Channel News, a high-level conference in Islamabad made the decision to make this move. Government politicians and high-ranking judges were there.
According to judicial sources, discussions with the chief justice of the Lahore High Court were finished, and final communication was being exchanged about the transfers with the high courts of Sindh and Balochistan.

There have been rumors that Justice Sardar Muhammad Sarfraz Dogar, a senior judge at the Lahore High Court, might be moved to the Islamabad High Court.

Justice Dogar is anticipated to be named the next Chief Justice once Islamabad High Court Chief Justice Aamer Farooq is promoted to the Supreme Court.
